This site will require a Terms of Service of some type. What do you want to see in it, what protections do you want as a cacher?

Read the TOS from the other cache sites and comment. Thanks.

I suggest something that says that anyone who redistributes the data, with or without changes, must pass along the freedom to further copy and change data. And not many more restrictions than that. Many examples of such licenses can be found here: http://www.gnu.org/licenses/license-list.html .

Hey I could be wrong, but the TOS is reallly for the protection of the site, not the users. But as a starting point I'd agree with Scout and say that the user has to agree that data submitted (cache entries, logs, photos) are done so under an open model ... this one seems to fit rather well. The further assurance would be that the data available for syndication is provided on the same basis; at this level I'd be referring to all data, less user information.

Design Science License

A seperate paragraph stating that with user consent, other data including the user profile may be distributed to other 'nodes' participating in the opencaching network.

Then finally there probably needs to be all the legal BS disclaimers about geocaching involving risk and the site isn't responsible if you fall off a cliff, get shot at, drown or are struck by a logging truck.

Well, if I'm reading the above right, you can exclude all of my caches from your list.

I will always retain the copyright of my caches and will not allow such to be changed by anyone.

There is still smoke coming from my ears because of the recent GC.com BS. I will not be giving up my caches to anyone.

If fact, you might start thinking about a way to make sure those who want their caches excluded from your lists to be able to do so.

That's straight from the license ... but you have to grant the right to redistribute otherwise there is no way to make the syndication work.

It also goes on to say ...

between the Work and the new derivative work, authorship is attributed

So if someone takes your cache idea, they can't just rip it off, they have to change it, yet provide attribution to the source.
